Legal Notice and Website Terms of Use

1. Website Operator

REMAX Italia develops the REMAX franchise network in Italy. The agencies that join the network are autonomous and independent businesses affiliated with REMAX Italia (the “REMAX Agencies”). Each REMAX Agency operates with full legal and economic independence and is solely responsible for its real estate brokerage activities and its relationships with its clients.

2. Acceptance and Eligible Users

Accessing and using the Website constitutes acceptance of this Legal Notice and these Terms of Use (the “Terms”). Anyone who does not wish to accept them should refrain from using the Website.

The Website and its services are intended exclusively for users aged 18 or over. By using the Website, and particularly the artificial intelligence features described in Section 4, users declare that they are at least 18 years old. REMAX Italia may suspend or prevent use of the Website or its features if it has reason to believe that a user is a minor. In that case, it will delete any data collected, subject to any retention obligations imposed by law.

3. Website Content and Property Listings

REMAX Italia takes care in preparing the Website’s content. However, it cannot guarantee that the Website will be free from interruptions, delays, errors or omissions arising from the nature of electronic communications.

Property listings and agent and agency profiles are posted by the REMAX Agencies, which are solely responsible for them. In particular, each Agency is responsible for ensuring that its listings are truthful, accurate, complete, not misleading and compliant with applicable law, including energy certification requirements. Each Agency is also responsible for the associated processing of personal data. Publication on the Website does not constitute approval of, or a guarantee concerning, listing content by REMAX Italia.

The published information is provided for informational purposes. It does not constitute an offer to the public, a contractual proposal, or a valuation or appraisal of a property. Property characteristics, prices and availability must always be verified with the relevant REMAX Agency.

4. Artificial Intelligence Features

4.1 AI-Assisted Search

The Website offers a search feature that uses an artificial intelligence system. The system interprets users’ requests expressed in natural language and suggests properties listed on the Website. When interacting with this feature, users acknowledge that they are using an AI system and are not communicating with a person.

Results are generated automatically and may be incomplete, inaccurate or irrelevant. They do not constitute:

1. an offer, proposal or advice of any kind;
2. a valuation of a property;
3. an assessment of the user’s circumstances, including their purchasing capacity or ability to obtain financing.

The search feature does not provide credit, financial or insurance advice and does not assess the user’s creditworthiness. For these services, users may contact authorised providers, including those within the REMAX group.

Users must always verify information with the relevant REMAX Agency before making any decision.

4.2 Information Entered into Search

Users are asked not to enter personal data that is unnecessary for the search. Examples include information about health, family, financial or employment circumstances, and data concerning third parties. The processing of information entered into the search feature is described in the Website’s Privacy Policy.

4.3 Prohibited Uses

The AI features must not be used to:

1. submit discriminatory requests, for example requests based on residents’ ethnic origin, nationality, religion, sexual orientation, disability or household composition;
2. obtain unlawful or offensive content, or content that infringes the rights of third parties;
3. circumvent or manipulate the system’s operation or its security measures;
4. extract data or content by automated means.

REMAX Italia may restrict or suspend access to the feature in the event of a breach.

4.4 Content Prepared with AI Assistance

Some descriptions of properties, agents and agencies may be prepared with the assistance of artificial intelligence tools provided by REMAX Italia. Such content is reviewed by the agent or REMAX Agency that publishes it, which assumes responsibility for it in accordance with Section 3.

Images that have been altered using AI, for example through virtual staging or changes to rooms, are marked accordingly. They do not necessarily represent the property’s current condition.

5. Limitation of Liability

To the extent permitted by law, REMAX Italia is not liable for losses or damage arising from:

1. interruptions or malfunctions of the Website that are not attributable to REMAX Italia;
2. listing content posted by the REMAX Agencies;
3. decisions made by users solely on the basis of AI search results without verification with the Agency;
4. content on linked third-party websites.

In all cases, REMAX Italia remains liable for wilful misconduct or gross negligence and where liability cannot be excluded or limited by law, including with respect to the rights granted to consumers under Italian Legislative Decree No. 206 of 6 September 2005 (the Consumer Code).

Users are liable for losses or damage caused to REMAX Italia or third parties through use of the Website in breach of these Terms or the law.

6. Intellectual Property and Trademarks

The Website’s content is protected by copyright and industrial property laws. This includes text, images, graphics, software, databases and trademarks. Such content may not be modified, reproduced, distributed or used for public or commercial purposes without the written consent of the rights holder.

This prohibition also applies to content prepared with AI assistance, the use of which is reserved to REMAX Italia and the REMAX Agencies.

Systematic or automated extraction of data and content from the Website (scraping) is prohibited, including for the purpose of training artificial intelligence systems. REMAX Italia expressly reserves such use pursuant to Articles 70-ter and 70-quater of Italian Law No. 633/1941.

REMAX and the REMAX logo are registered trademarks. Their use requires written authorisation from REMAX Italia, which may be requested through the “Contact Us” page.

7. Links to External Websites

Links to third-party websites are provided as a service to users. REMAX Italia does not control those websites and is not responsible for them.

Links to the Website are prohibited if they:

1. use REMAX trademarks without authorisation;
2. conceal the Website’s URL;
3. bypass the homepage or pages containing these Terms.

REMAX Italia may request the removal of any link to the Website.

8. Privacy and Cookies

The processing of users’ personal data, including data entered into the AI features, is described in the Website’s Privacy Policy and Cookie Policy.

9. Changes

REMAX Italia may change these Terms and the Website. The updated version will be published on this page, together with the date of the last update. Changes will not have retroactive effect.

10. Governing Law and Jurisdiction

These Terms are governed by Italian law. Disputes involving users who are consumers are subject to the mandatory jurisdiction of the courts of the place where the consumer resides or is domiciled. The courts of Milan have exclusive jurisdiction over all other disputes.
